1. Introduction

Welcome to the Terms of Service (ToS) for SummitRP, a GTA V and FiveM roleplay community hosted on summitrp.gg. By accessing or using our website, dashboard, Discord community, or in-game server, you agree to be bound by these ToS, our Privacy Policy, and our Server Rules & Guidelines.

2. General Terms

• SummitRP reserves the right to change, modify, or update these ToS at any time without prior notice.
• We reserve the right to terminate, suspend, or modify our services, or any portion thereof, at any time.
• We are not responsible for any damages or losses incurred as a result of using our services.
• SummitRP is not affiliated with Rockstar Games, Take-Two Interactive, Cfx.re, or any entity associated with the Grand Theft Auto series.
• Our services are provided on an “as is” basis with no guarantee of uninterrupted or error-free operation.

3. Eligibility

SummitRP is an 18+ roleplay community. You must be at least 18 years of age to use our services. By participating, you confirm that you meet this requirement.

A working microphone and headset are required to roleplay on SummitRP. If you have difficulty speaking, you must open a Discord ticket to arrange alternative roleplay accommodations.

4. Account Responsibility

Your account is solely your responsibility. The ruleset and guidelines apply universally across all platforms associated with SummitRP, including but not limited to FiveM, Discord, and any other accounts used for interaction, socializing, or playing in our community. You may not share account credentials with others.

5. Server Rules & Conduct

All players must follow our Server Rules & Guidelines. The following conduct standards are enforced in addition to the full ruleset:

• Cheating, exploiting, macro/autoclicker use, or advantage-providing mods result in a permanent ban.
• Zero tolerance for racism, bullying, discrimination, homophobia, sexism, sexual harassment, and related toxic behavior - this may result in permanent removal from the city and Discord.
• Erotic roleplay (ERP) and other prohibited RP themes (including but not limited to rape RP, child RP, terrorism RP, and torture RP without consent) are strictly forbidden.
• Remain in character at all times. Report rule breaks via the Discord ticket system - do not DM staff unless they contact you first or it is an emergency.
• Staff may take action at their discretion, including removal from the community, even when a specific rule is not listed.
• Rules and guidelines are subject to change without notice.

6. Store & Tebex Purchases

• All purchases made through our store (checkout on our website, processed securely by Tebex) are final and non-refundable.
• Items or products purchased through Tebex may not be openly traded, gifted, or sold - in-character or out-of-character. Violations may result in a permanent ban.
• Digital goods are delivered immediately upon purchase. See our full Refund Policy for details.

7. Chargebacks

Chargebacks are considered fraudulent by payment processors and result in fees for the server. Initiating a chargeback without first contacting staff may result in a permanent ban from SummitRP. If you encounter any payment issues, reach out to us on Discord before disputing a charge.

8. Disclaimer of Warranties

• No warranties, express or implied, are made regarding the accuracy or reliability of our services.
• We do not guarantee that our services will be error-free or uninterrupted.
• SummitRP is not responsible for any damages or losses incurred as a result of using our services.

9. Limitation of Liability

• We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our services.
• Our liability shall not exceed the amount you paid for our services.

10. Indemnification

You agree to indemnify and hold harmless SummitRP, its staff, and affiliates from any claims, damages, or expenses arising out of your use of our services or violation of these ToS.

11. Governing Law

These ToS are governed by the laws of the United States, without regard to conflict-of-law principles.

12. Entire Agreement

These ToS, together with our Privacy Policy and Server Rules & Guidelines, constitute the entire agreement between you and SummitRP.
